These refund and returns and terms of service (the “Terms and Conditions”) govern the use of https://fibreopticstraining.co.uk (the “Site”), an E-Commerce website owned and operated by Total Network Solutions (Europe) Trading as Fibre Optics Training UK.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to always abide by them.

We are legally obligated to supply goods that match the description of the good(s) you order on our Site.

The services will be paid for in full when the services are ordered.

These Terms and Conditions apply to all the services displayed on our Site when you access it. All information, descriptions, or images we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions, or pictures, as we cannot guarantee the accuracy of all services we provide. You agree to purchase services from our Site at your own risk.

We reserve the right to modify, reject, or cancel your order whenever necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that you are responsible for monitoring your payment instrument to verify receipt of any refund.

Payments

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

Course Cancelation and Transfer

Cancellations received on the day will incur the full fee. No refunds shall be made.

If a cancellation is received within one working day (24 hours) before the event, 100% of the fee will be required.

If cancellation is received within ten working days (10 days) before the event, 50% of the fee will be required or refunded if full payment has been received.

If you wish to transfer your booking to a later date, you may do so but no less than five working (5 days) before the original course date. You may only transfer the course date no refund will be given if transferred.

In these instances, no additional cost is involved if full payment has already been received. However, TOTAL NETWORK SOLUTIONS (EUROPE) Ltd reserves the right to cancel any course or service after giving the buyer written notice.; and

Consumer Protection Law

Where the Sale of Goods Act 1979, the Consumer Rights Act 2015, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Limitation of Liability

Total Network Solutions (Europe) Trading As Fibre Optics Training and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses, including legal fees, resulting from your use of the Site.

Indemnity

Except where prohibited by law, by using this Site, you indemnify and hold harmless Total Network Solutions (Europe) Trading As Fibre Optics Training and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Delegate sustainability

It is the customer’s responsibility to ensure that the course is suitable for their requirements and that they hold the prerequisites for the course. All delegates should have read and understood the course outline and met the necessary prerequisites. They may be asked to bring evidence to support the knowledge and prerequisite requirements.

Delegates who do not meet the course prerequisite requirements may not be allowed on the course. However, they will be liable for full payment of the course fees.

Personal protective equipment/tools/equipment requirements

Our joining instruction or framework agreements will define the requirements for appropriate Personal Protective Equipment (PPE), specialist tools, plant and equipment required for the course.

These items must be fit for purpose, with appropriate checks and calibration if required. Failure to provide these items or their condition may result in the course being abandoned, which will incur a full course charge..

Should a delegate fail the course as they have not met the requirements, a rebooking fee applies to rebook examinations £150.00 plus VAT. They must wait seven working days (7 days) before retaking the exam.

Severability

If any of the provisions outlined in these Terms and Conditions are found to be inconsistent or invalid under applicable laws at any time, they will be deemed void and removed from these Terms and Conditions. The removal will not affect all other provisions, and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time to comply with the law and reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email or post a notice on our Site of changes to these Terms and Conditions.
